1. OVERVIEW

This website is operated by Anaté (registered in Hong Kong). Throughout the site, the terms “we”, “us” and “our” refer to Anaté. By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions.

2. GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including credit card information) may be transferred unencrypted and involve transmissions over various networks. Credit card information is always encrypted during transfer over networks.

3. INTELLECTUAL PROPERTY

All content included on this site, such as text, graphics, logos, images, audio clips, digital downloads, jewelry designs, and software, is the property of Anaté or its content suppliers and protected by international copyright and trademark laws. You may not use, reproduce, duplicate, copy, sell, resell, access, or exploit any portion of the Service, our designs, or our brand assets without express written permission by us.

4. PRODUCTS & CRAFTSMANSHIP GUARANTEE

We have made every effort to display as accurately as possible the colors and images of our products. We cannot guarantee that your computer monitor's display of any color will be accurate.

The Anaté Guarantee: We stand behind the quality of our jewelry. All Anaté pieces are covered by a 1-Year Craftsmanship Guarantee starting from the date of delivery.

• Coverage: This guarantee covers manufacturing defects, including loose stone settings, clasp failures, and structural weakness under normal use.

• Exclusions: This guarantee does not cover oxidation, natural tarnishing of metals, general wear and tear, or damage resulting from accidents, mishandling, or improper care (e.g., exposure to harsh chemicals). Lost or stolen items are not covered.

To initiate a guarantee claim, please contact us with your order number and clear photos of the defect. We reserve the right to determine if a defect is due to manufacturing or wear and tear.

5. MODIFICATIONS TO THE SERVICE AND PRICES

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

We reserve the right to cancel orders if a product is listed at an incorrect price due to a typographical error or error in pricing information. If your card has already been charged for the purchase and your order is canceled, we will issue a full refund immediately.

6. ORDER CANCELLATION

You may cancel your order free of charge at any time before it enters fulfilment. To cancel, log in to your account, open the order, and select “Request cancellation”. If you have any trouble, contact us at support@anate.co with your order number.

In-stock pieces typically enter fulfilment within 24 hours of ordering, sometimes sooner. Made-to-order pieces may be cancelled until production begins, typically within 24 hours of ordering, sometimes sooner.

Once an order has entered fulfilment or production, it can no longer be cancelled — but it may still be returned after delivery in accordance with our Returns & Refunds Policy; note that return shipping costs may apply as set out in that policy.

Confirmed cancellations are refunded in full to the original payment method. We issue the refund when we confirm your cancellation; depending on your bank or card issuer, it may take up to 10 business days to appear on your statement.

7. ORDER VERIFICATION & DISPATCH

To ensure the highest standards of service, Anaté documents the fulfillment process of every order.

• Quality Control: We photograph the contents of orders immediately prior to sealing the package.

• Disputes: These internal records serve as confirmation of the item’s condition and presence at the time of dispatch. In the event of a dispute regarding missing items or empty packages, these records will be used as the primary evidence to resolve the claim.
  
  

8. SHIPPING, TAXES & DUTIES

We currently ship to Hong Kong, Singapore, United States, Canada, Australia, New Zealand, Switzerland, Israel, and the European Union, with the following conditions:

• Duties & Taxes Included: To ensure a seamless experience, we ship on a Delivered Duty Paid (DDP) basis. All applicable import duties, VAT, and sales taxes are included in the final price you pay at checkout.

• No Hidden Fees: You will not be charged any additional fees upon delivery. The price you see at checkout is the final price.

We also ship to the United Kingdom and Georgia, where customers will have to pay relevant duties & taxes, as required by local authorities.

9. RETURNS & REFUNDS

Returns and refunds are governed by our Returns & Refunds Policy, available at anate.co/policies/refund-policy, which forms part of these Terms. All returns must be initiated through our returns portal at return.anate.co. In the event of any inconsistency between these Terms and the Returns & Refunds Policy, the Returns & Refunds Policy prevails in relation to returns and refunds.
Returns are received and inspected at a returns centre operated on our behalf by a third-party logistics provider. Anaté remains responsible to you for the handling of your return and refund.

10. USER COMMENTS, PHOTOS & SUBMISSIONS

We love seeing how you style our pieces. If you send us creative ideas, suggestions, photographs, or videos (collectively, 'Submissions'), or if you tag us in social media posts, you agree to the following:

• License to Use: You grant Anaté a perpetual, irrevocable, royalty-free, transferable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such Submissions throughout the world in any media.

• Usage: This includes the right to use your photos or videos for marketing purposes, including but not limited to our website, email newsletters, digital advertisements, and social media channels.

• No Obligation: We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.
  

11. PERSONAL INFORMATION

Your submission of personal information through the store is governed by our Privacy Policy. To view our Privacy Policy, please visit anate.co/policies/privacy-policy. 

12. PROHIBITED USES

In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to submit false or misleading information; (f) to upload or transmit viruses or any other type of malicious code; or (g) to interfere with or circumvent the security features of the Service. We reserve the right to terminate your use of the Service for violating any of the prohibited uses.

13. LIMITATION OF LIABILITY

Anaté shall not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service.

14. SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

15. GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Hong Kong SAR.
